Terms of Service

1. Acceptance of Terms

By creating an account or otherwise using MaxYourScore ("the Service"), operated by MaxYourScore ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

When you create an account, by email or by signing in with Google or Apple, you accept these Terms and our Privacy Policy. We record which version you accepted and the time you accepted it.

2. Eligibility

• You must be at least 13 years old to create an account or use the Service. Sign-up includes an age step, and we do not keep accounts for anyone under 13.
• If you are under 18, you may use the Service only with the permission of your parent or legal guardian. Your parent or guardian agrees to these Terms on your behalf and is responsible for your use of the Service, including any purchases.
• We may close any account that does not meet these requirements.

3. Description of Service

MaxYourScore is an AI-powered educational platform that provides AP® exam preparation resources including video lessons, flashcards, practice exams, quizzes, note packets, score estimates, and an AI tutor. The Service is available on the web at maxyourscore.com.

MaxYourScore is an independent product. It is not affiliated with, and is not endorsed by, the College Board.

4. Accounts

• You must create an account to access most features of the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must provide accurate and complete information when creating an account, including at the age step, and keep it up to date.
• You may not share your account with others or create multiple accounts for the same person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions, Free Trial, and Automatic Renewal

• Plans. Some content is free. Paid plans are sold per AP subject and, where offered, as a plan covering all subjects. Subscriptions are billed monthly or yearly, in US dollars, at the price shown at checkout.
• Free trial. Your first subscription starts with a 3-day free trial. The trial is available once per person. You enter a payment method when you start the trial.
• Automatic renewal. Unless you cancel before the trial ends, your payment method is charged the plan price when the trial ends, and your subscription then renews automatically at the start of each billing period (every month or every year, depending on your plan) until you cancel.
• How to cancel. You can cancel online at any time: open Settings, choose "Manage billing", and cancel in the billing portal. Cancelling stops future charges. You keep access until the end of the period you have already paid for.
• Refunds. Every paid plan has a 30-day money-back guarantee. After 30 days, payments are not refunded and we do not give prorated refunds for unused time. See section 6 and our Refund Policy.
• One-time passes. Where a one-time pass is offered, it is a single charge for a fixed period and does not renew.
• Payment processing is handled by Stripe. By making a purchase, you also agree to Stripe's Terms of Service.
• We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

6. Refund Policy

We offer a 30-day money-back guarantee on all paid plans. After 30 days there is no prorated refund. If a subscription payment is refunded in full, or is reversed through a payment dispute, that subscription is cancelled and access under it ends. See our Refund Policy for full details.

Every subject except AP 2-D Art and Design, AP 3-D Art and Design, AP Drawing and AP Research also carries a Score Guarantee, subject to the conditions in the Refund Policy. AP 2-D Art and Design, AP 3-D Art and Design and AP Drawing are portfolio-assessed and have no practice exams. AP Research has no end-of-course AP exam; its score comes from a paper, presentation, and oral defense. Subscriptions to these four subjects carry the 30-day money-back guarantee only.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Share, redistribute, or commercially exploit content from the Service, including video lessons, practice exams, and AI-generated content.
• Attempt to reverse-engineer, decompile, or extract the underlying algorithms, models, or data of the Service.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Interfere with or disrupt the Service or servers connected to the Service.
• Impersonate another person or misrepresent your affiliation with any entity.
• Use the AI tutor or any other feature to generate content unrelated to AP exam preparation (e.g., writing essays for school assignments).
• Upload or transmit viruses, malware, or other harmful code.

8. Intellectual Property

• All content on the Service, including video lessons, practice exams, flashcards, note packets, AI-generated content, software, and branding, is owned by MaxYourScore or its licensors and is protected by copyright and other intellectual property laws.
• Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes.
• AP® and Advanced Placement® are registered trademarks of the College Board, which is not affiliated with, and does not endorse, this product.

9. AI Tutor and AI-Generated Content

• Much of the content on the Service, including video lessons, practice questions, explanations, feedback on written answers, and tutor replies, is generated with AI.
• AI output can be wrong. Do not rely on it as your only source of information; check it against your class materials and official College Board resources.
• AI-generated content is not official College Board material, and our practice questions and exams are not released College Board exams.
• The AI tutor is designed not to give the final answer to a specific practice or assessment question. It explains concepts, gives hints, and may work a different, analogous example.
• Scores and feedback from AI grading are estimates and may differ from how an AP reader would score the same answer.
• Score estimates are based on your practice performance and are not guaranteed outcomes.
• What you submit to AI features is sent to our AI provider to generate the response. Our Privacy Policy explains how.

10. User Content

If you submit content (such as study notes, flashcards, or feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service. You retain ownership of your content.

11. Disclaimers

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
• We do not guarantee any specific AP exam score or academic outcome. The Score Guarantee in section 6 is a refund commitment, not a promise that you will earn a particular score.
• We are not affiliated with, endorsed by, or sponsored by the College Board.

12. Limitation of Liability

To the maximum extent permitted by law, MaxYourScore shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or academic outcomes. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless MaxYourScore and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Modifications to Service and Terms

• We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
• We may update these Terms from time to time. Material changes will be communicated by email or by a notice in the Service at least 30 days before they take effect.
• Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

16. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.
